Terms of Service — 3x3 Moments

1. Provider and Legal Information

This website and the photography services are operated by:

Anyone who uses this site or purchases a service (the "User" / "Client") accepts these terms.

2. Description of the Service

3x3 Moments offers lifestyle and candid photography in Barcelona: photo-session bundles, delivery of edited photos and short videos, and products in the "Artisan Collection" section. What each bundle includes, the number of people and prices are stated on the relevant package page. Locations are chosen by 3x3 Moments; food and drinks are at the client's own expense (unless stated otherwise).

3. Booking and Payment

  1. Channel. Bookings are made via the online booking page and/or GetYourGuide and Airbnb Experiences; those platforms' own terms also apply.
  2. Payment. On the online booking page the price is paid in full at the time of booking; there is no deposit or remaining balance. Payments are processed through PayPal; we do not see or store your card details.
  3. Booking from Turkey. As PayPal is not available in Turkey, online payment will not work; an alternative method is arranged via info@3x3moments.com.
  4. Prices. Apply in the relevant currency and with applicable taxes. The price of a confirmed booking does not change.
  5. Additional people. A 3rd and 4th person may be added for a per-person fee. Maximum 4 people per session.

4. Cancellation, Refund and Rescheduling

  1. Refund. Cancellations made up to 48 hours before the session are fully refunded.
  2. Rescheduling. The session may be moved once, free of charge, provided you give at least 48 hours' notice.
  3. Weather. Beautiful results are possible even in the rain; if you wish to proceed, the session goes ahead. In severe or unsafe weather (e.g. storms) the session is rescheduled to a mutually convenient date at no extra cost.
  4. No-show. No refund is given for a no-show without notice.
  5. For bookings via GetYourGuide/Airbnb, that platform's rules may take precedence.

5. Delivery

  1. Edited photos are delivered within 10 days for Paseo and Bodega, 15 days for Jornada via an online gallery; the gallery stays accessible for 14 days, and downloading the files within that time is the client's responsibility.
  2. Photos are carefully selected by 3x3 Moments; extra photos are available on request for an extra fee.
  3. Raw / unedited files are not delivered. Every photo you receive is hand-selected and fully edited.
  4. Backups are not guaranteed after the gallery period; long-term storage is the client's responsibility.

6. Intellectual Property and Licence

  1. Copyright. Unless agreed otherwise in writing, all rights in the photos and videos belong to 3x3 Moments / the photographer.
  2. Client licence. The client may use the delivered images for personal, non-commercial purposes, share and print them. Commercial use requires separate written permission.
  3. Portfolio / promotional use (image rights — LO 1/1982). Using images in which the client/people in the session are identifiable in the portfolio, website and social media (e.g. Instagram) is subject to those persons' explicit consent. Consent may be withheld or withdrawn (info@3x3moments.com). See the Privacy Policy.

7. Shop / "Artisan Collection" Products

  1. Product description, price and stock are stated on the product page; in case of error, 3x3 Moments reserves the right to cancel/correct the order.
  2. Handmade products are prepared within 10–14 business days after your shoot; shipping cost and delivery regions are shown at the time of order.
  3. Personalized products and the right of withdrawal. Products in the "Artisan Collection" are made to order according to the client's specifications or clearly personalized. Under Article 103(c) of Spanish Royal Legislative Decree 1/2007 (TRLGDCU) and Article 16(c) of Directive 2011/83/EU, such goods are excluded from the 14-day right of withdrawal. Therefore, once an order is confirmed, it cannot be cancelled or refunded on withdrawal grounds. This is clearly disclosed and acknowledged at the time of ordering.
  4. Statutory guarantee preserved. The exclusion above does not affect your statutory rights where a product is defective or not as described, which remain covered by the legal guarantee.

8. Client's Obligations

Be ready at the agreed place/time; provide accurate information; obtain any necessary permissions for the use of images of other people in the session; comply with public-space rules.

9. Limitation of Liability and Force Majeure

Reasonable professional care is applied; given the creative nature of the service, no guarantee of a specific "exact" result is given. In cases of force majeure (illness, equipment failure, extreme weather, administrative restriction, etc.) the session is rescheduled; if that is not possible, the amount paid is refunded. Liability for indirect damages is limited to the maximum extent permitted by law. Site content is provided "as is".

10. Governing Law and Dispute Resolution

These terms are governed by Spanish law. For consumer disputes, the EU ODR platform: https://ec.europa.eu/consumers/odr. For consumers, the competent court is determined by applicable law; otherwise the courts of Barcelona have jurisdiction.

11. Changes and Contact
